Village of Dalton
The Board of Trustees convened in open and public session for a regular meeting October 13th, 2025, at 7:00 p.m. at the village office. Board Chairman R. Flohr called the meeting to order. The Pledge of Allegiance was recited. Roll was called. Present: Board members, R. Flohr; W. McConnell; J. Schmitt; H. Buchert, arriving at 7:08 p.m.; and A. Abbott. There were five guests present.
The Nebraska Open Meetings Act was read and acknowledged as posted. All following motions carried unanimously unless otherwise stated.

Board Reports: R. Flohr: Gave thanks to the Fall Festival Committee. The event was well planned and organized. Also, thank you to Trevor Schuessler for our budget preparations. W. McConnell: Inquired about potholes in the streets. Another company may be able to start on the project this coming May when it warms up. There is not enough time left this year to complete the project. It was suggested to fill in the worst spots with the materials the Village already has. Inquired about the speed sign for the North end of town. Eli Weyerts began fixing the sign today. Maintenance: Water tests passed for September. Sidney performed water jetting on the sewer lines. The trailer park and south park bathrooms are winterized. Lead water line information was given to the board. The Village has until 2037 to replace all lead/galvanized lines. It was reported that the Village does not have any lead on our side of the lines. There are still several customers who have lead pipes. As of right now, customers are not required to replace lead/galvanized pipe on their end.
Cheyenne County Sheriff Adam Frerichs reported how the Sheriff’s Office handles dogs. If it is a dog running at large, they do not do anything. If it is a dangerous dog, meaning it has a propensity to act aggressive to another animal or person, barking, growling, pursuing; the Sheriff’s Office will contact the owner and issue a dangerous dog notification. The notification has certain steps the owner must take including the type of kennel required: concrete sides buried in the ground and a roof to ensure the dog does not escape the enclosure, the dog cannot be outside of the owner’s control-if the dog is out of the enclosure or fence it must be on a leash, and the owner must post signs of a dangerous dog on the property. If another incident occurs, the Sheriff’s Office will issue a dangerous dog citation, which enters the owner into the court system. The dangerous dog notification can be skipped and move straight to a citation only if the dog kills or harms another animal or human. Lodgepole enacted an ordinance that prohibited dogs running at large within the village. Notification of any violation was sent to residents by the Village Attorney. If citizens of the Village call the Sherrif’s Office to notify of a dog running at large, the sheriff’s Office documents every time a dog is out. This can be used in court, should the matter have to go that far. Discussion was held about enacting a Village Ordinance for Dalton similar to Lodgepole. Recently, there have been issues with dog owners not picking up registered letters outlining violations of ordinances already in place. The Village does have the option to utilize the Sheriff’s Office to serve letters to residents rather than send registered letters. Speeding through Dalton was also discussed with the Sheriff. Deputy presence curbs the problem while they are in town. Sheriff gave the option of bringing their radar speed sign to Dalton.
Ordinance 2025-10-13 (an ordinance of the Village of Dalton, amending chapter 93 of the Code of the Village of Dalton, providing for the limitation of dogs and cats within the municipality; adding section 93.46 to the Municipal Code of Dalton relating to the limitation of dogs and cats within the municipality; to establish fees for violation; to repeal conflicting ordinances and sections; and to provide an effective date) was presented. Discussion took place. Motion Buchert, Second Abbott, that the statutory rule requiring the Ordinance to be read by title on three different days be suspended. Roll Call-Ayes: J. Schmitt, H. Discussion was held regarding the Village insurance. The Village insurance policy is currently with LARM. Since 2022, the premium has increased by $8,195 with the largest increase taking place between the 24-25 and 25-26 pool year in the amount of $4,605. The Village has not submitted any claims since insurance was moved to LARM. An assessor from LARM will be in Dalton Wednesday, October 15th, in which members of the board will discuss lowering values of commercial buildings listed on the property or other avenues the Village can take to try to lower the cost of insurance.
Motion Buchert, Second Abbott, to approve a bid from Dan’s Tree Service in the amount of $2,500 to remove a deceased tree from North Park.
Earl Reilly reported that there are six or seven dead trees at the cemetery that need to be removed. Discussion was held about replanting trees. Questions arose about who is responsible should a tree fall and damage a headstone. Inquiries need to be made to the Village insurance regarding if the Village would be at fault or if the responsibility of repairing the headstone falls upon the lot owner. Earl has been having issues with the air compressor that is at the cemetery. It was advised to take the compressor to Eli Weyerts. If the compressor is unrepairable, Earl will look into purchasing a new one. The Walker mower needs new tires and belts.
Motion Buchert, Second Schmitt, to approve the draft of an application for Solicitor’s Permit. Village Ordinances require a permit for peddlers, of which none could be found. Spectrum would like to do door-to-door sales for fiber they recently install throughout the village.
A report was given regarding the Hazard Mitigation Generator Grant furnished by Nebraska Emergency Management Agency. After discussion, it was concluded that the Village does not have the funds to complete the project. Due to no motion being presented, the item died.
Eight formal complaints pertaining to dogs in the village were reviewed. Letters have been sent to the owner and law enforcement is involved in the matter.
The next regular board meeting is scheduled for November 10th, 2025 beginning at 7:00 p.m.
